Assessment of the copyright and related rights system

 

The project for establishing a methodology for a systematic assessment of the copyright and related rights system was launched in May 2009. The project is financed by the Finnish Ministry of Education and Culture and it is carried out in English.

 

The core project group consists of researcher Tiina Kautio (project coordinator) and Jaakko Eskola, Ombudsman of the Foundation, and since September 2010 as part-time researchers Nathalie Lefever and Mikko Karaiste joined the group. CUPORE contracted, after a call for proposals, Accenture to act as the leader of the Project for its initial stage in 2009. Two expert groups were established to support the work of the project group. The Scientific Board comprises of experts in impact assessment methodology and is chaired by the Research Director of CUPORE, Ritva Mitchell. The Expert Group on Copyright Matters is comprised of Finnish copyright professionals.  The Copyright Task Force of the Ministry of Education and Culture has actively taken part in the project. Contact has been established with the secretariat of WIPO with the aim that if the project does produce a well-functioning methodology, it could be further developed for possible international use. Senior researchers Pasi Saukkonen (on a leave of absence at the University of Helsinki) and Sari Karttunen from CUPORE are members of the Scientific Board.

 

The objective of the project is to form a set of evaluation methods for the formulation of copyright and related rights policies and strategies, and developing copyright and related rights system on the national and international level. The assessment of the copyright system is determined by identifying and assessing the relevant key indicators that help in recognizing trends and best practices. The assessment adds to the transparency of copyright system which brings about new possibilities for the various stakeholders to discuss the copyright  policy. The aim is to establish a framework for international use.

 

The work process involves analyzing different stakeholder groups and internal and external processes. Based on relevant key questions, a set of evaluation methods has been established for the assessment of the various elements of the copyright system and the copyright system as a whole. The indicators and research methods are descriptive, quantitative or qualitative. The methodology is developed for evaluating the operation of the copyright and related rights system, but it is also useful in assessing the economic, cultural and social impact of the copyright system and the realization of the principles of good governance.

 

The project will be carried out in two stages:

Stage 1. Establishing an assessment methodology: Developing a methodology, evaluating its feasibility and documentation in the form of a methodology handbook

Stage 2. Testing and implementation of the methodology

 

The first stage of the project continued until the end of 2010. The methodology has been tested and revised on the basis of international experts' comments in 2011. In addition, a toolkit of 11 surveys has been drafted to provide more detailed instructions for collecting information. Testing the indicators is ongoing. The methodology handbook will be finalized during the spring 2012.
